It's not a bug, it's a feature. It was actually intended by Blizzard. However that's very easy to remove, just gotta get a confirmation from Marco on whether it's meant to stay that way or not.

The only interesting things that D3 has brought to me is, a nice GUI, and visual representation of lore characters that weren't before (I'm thinking of azmodan, belial, imperius, etc...), so hey why not take it. It's also a matter of how much time we are willing to waste on the GUI. D2 GUI is quite dull and outdated, and creating our own brand new GUI from scratch would require dedicated artists and lots of time... D3 offers a vast amount of GUI resource to work with, with very little effort, and looks more than enough good. It also happens to blend-in well most of the time once converted to the very limited D2 palette, which is a factor to take into account (before some come and say, yeah ok but, you could have taken the GUI from another game). Also taking the GUI from another game feels a little strange, compared to taking the GUI from a game of the same franchise.
There were also 2-3 ideas that may have been inspired from Diablo III, I'm thinking of the different resource for every class, or the bounty task system, but after all Diablo III was not bad in every single of it's aspects, so why not take the very few good things it had to make this mod even better. It may also attract more the weirdos that seem to prefer D3 over D2.
Thoughts of the like "I hated D3 so I hate this mod because it uses D3 GUI" are kind of dumb...And user theming was implemented exactly for this kind of comments.
